How to get a Bahamas Investment Fund License?

Bahamas Investment Fund Licenses are issued by the Securities Commission of the Bahamas also called SCB. A Bahamas Investment Fund License is issued under the provisions of the Investment Funds Act, 2003 and the Investment Fund Regulations, 2003. As a prerequisite for applying for a Bahamas Investment Find License, it has to be determined which type of fund you want to operate and your target group of customers.

If you are not registered in any of the foreign jurisdictions and wish to target the retail market, then you will most likely be required to apply for the license for a standard fund. If you are registered in a recognized foreign jurisdiction and fulfill the requirements under the local law, you can obtain an exemption from a license and may be able to operate through a simple process of registration.

To fulfill the application requirement for a license, all investment funds must appoint a custodian for the funds and a licensed investment fund administrator. In addition to these requirements, the funds have to submit information about the fund vehicle and details of the Parties Related to the Investment Fund. After application, SCB may seek further clarification or request additional documents which you will have to respond with support from your Bahamas Investment Fund License consultants. Once approved, SCB will issue you the investment fund license which you will have to renew annually by paying a fee.
